Visa Interviews at Consulate


Consulate Interviews - When an aspiring immigrant applies for a visa outside the United States, he is required to have an interview at the U.S. Consulate in the home country. The interview takes place after the visa petition is approved. The consular official will determine whether a visa should be issued to the individual. It is important to be well prepared for the consular interview in order to be approved.

Permanent residence green cards can be obtained in two ways: issuance of an immigrant visa at a United States consulate abroad or through adjustment of status while in the United States. For some individuals adjustment of status is not available, so they are left with consular processing.

It is important for individuals considering consular processing not to pursue it blindly. If an individual leaves for a consulate interview and discovers that s/he is not eligible for the visa, s/he will likely have a difficult time returning to the United States.

In most cases, the alien will interview at the consular post in the alien's home country; however, there are exceptions for hardship, extenuating circumstances or humanitarian considerations.

Consulate Appeals - Sometimes the consular official denies an immigrant visa after the consular interview. It is important to act fast in these situations. In some cases, it is possible to change the consular official's mind or convince a supervisor to overturn the decision. If an individual does not act fast,the file might be transferred back to the United States for an official denial. Once that happens, the time for processing the case will lengthen a great deal.
