E-3 Visa for AustraliansThe E-3 non-immigrant visa is exclusively for Australians. The E-3 visa was a result of the United States - Australia Free Trade Agreement. The E-3 is similar in many ways to an H-1B visa; however, spouses of E-3 visa holders may work in the United States.
Additionally, the E-3 visa is valid for two years, but unlimited extensions are available. There is an annual limit of 10,500 E-3 visas per year. Similar to the H-1B visa process, the prospective employer of the E-3 visa applicant must first apply for a labor condition application with the U.S. Department of Labor. If the LCA is granted, the E-3 applicant can apply for the visa at the U.S. consulate in Australia. Australians already present in the United States may apply to change status to an E-3 visa; however, changing status is not possible if the visa applicant entered the United States under the visa waiver program.
