Immigration Services > Unreasonable Processing Delays

With almost any immigration application process, delays are to be expected. USCIS and other immigration-related agencies receive thousands of applications for various benefits every week. However, some delays are entirely unreasonable, and legal intervention is necessary in order to end the delay and finalize the process.

Many aliens awaiting a decision take a passive position on their pending case. Some wait indefinitely for a decision, while others attend Infopass appointments only to hear that the case is "still pending" or "under investigation." Neither strategy is likely to produce results.

Most aliens do not realize there are many other options available to ensure that the case is adjudicated promptly. First, attorney Infopass appointments tend to elicit much more attention from USCIS officers. Managing attorney Jay Nuñez has worked with many of the infopass officers in the past, and he knows how to get results from them. Second, AILA (American Immigration Lawyers Association) liaisons can intercede and inquire as to the delay of a specific case; however, you must be a member of AILA to use the AILA liaison. Managing attorney Jay Nuñez is an active and involved member of AILA. Third, federal court intervention and writs of mandamus can be used to force USCIS to process your immigration case.

Managing attorney Jay Nuñez has filed writs of mandamus in numerous federal courts in order to move cases along. Fourth, congressional intervention is an option. Congressional representatives are generally willing to step in if one of their constituents is experiencing an unreasonable delay. Managing attorney Jay Nuñez has worked with congressional representatives from countless districts and several states to help his clients end ongoing delays.

The worst thing you can do is wait and hope that the delay will end on its own. In some cases, USCIS loses the aliens' file and tells the aliens that the file is still pending in order to avoid further inquiry. Delays in processing are rarely the fault of the alien.

If you are experiencing a delay in the processing of your case, call The Nuñez Firm today to schedule a free consultation. Managing attorney Jay Nuñez will be able to discuss your case with you and determine which strategy is best in order to resolve your case and achieve the goal you are entitled to.
