P-1 Visas

The P nonimmigrant category is for performing groups, athletes, and culturally unique performers, teachers and coaches. There are three subcategories to the P classification. P-1 visas are for internationally known athletes (as either individuals or as part of a group/team), and entertainment groups. P-2 is for alien performing artists under a reciprocal exchange program. P-3 aliens are culturally unique entertainers. All three of these subcategories allow for accompanying personnel to travel with the visa holder.

Those seeking P-1 classification must prove "a high level of achievement in the field evidenced by a degree of skill and recognition substantially above that ordinarily encountered, to the extent that such achievement is renowned, leading, or well known in more than one country." 8 CFR 214.2(p)(3).

The standard for athletes pursuing P-1 status is easier than O-1 status. Athletes pursuing O-1 must show "sustained national or international acclaim," while P-1 athletes must show that they are performing at "an internationally recognized" level.

P-1 classification may be accorded to entertainers as well. Generally, entertainment groups are eligible for P-1 classification as opposed to individual entertainers. P-1 status is granted on the basis of the group’s reputation rather than individual achievement. Individual artists with accompanying group members should normally pursue an O-1 visa for the lead entertainer and O-2 visas for the other group members.

All P categories allow for essential support personnel, which is defined as "a highly skilled, essential person" who is an "integral part" of the performance of the P alien because the alien performs support services that cannot be readily performed by a US worker. Essential support personnel are not performers.

Initial P petitions for individual athletes may be valid for up to five years. An extension for a second five year period is available, but the total stay cannot exceed ten years. Petitions for athletic teams or entertainment groups may be valid for up to one year or the time necessary to complete the competition.
