What Constitutes Extraordinary Ability?
The O-1 petition must establish that the beneficiary has met the standards or demonstrated that he or she possesses sustained national or international acclaim and recognition in his or her particular field and that the alien is coming to work in that field (but not necessarily that the particular duties to be performed require someone of such extraordinary ability).
The types of evidence generally requested by USCIS for O-1 petitions depend on the area of work or field in which the O-1 performs. Major international awards, national awards, membership in groups or organizations which require high achievement in the field, prior employment in high levels, high salary compared to peers, and significant published material are some examples of useful evidence for O-1 cases involving extraordinary ability in science, education, business or athletics. The list of relevant evidence is extensive, however.
For O-1s in the arts, receipt of major awards, international notoriety, starring roles, significant critical acclaim, prior government acclaim, prior notable commercial success and high salary are all examples of useful evidence.
