If an alien is granted asylum or admitted to the United States as a refugee, s/he may request that the spouse and unmarried children under 21 years of age be granted admission to the United States. The petition is made on the I-730, and must be filed within two years of being granted asylee or refugee status. An I-730 must be filed for each individual family member and should include supporting evidence to prove the relationship.

The supporting evidence should include the marriage certificate (if I-730 is for spouse), birth certificate (if for a child), proof of emotional and financial ties to the child, recent photo of the family member, proof of asylee or refugee status (notice of granted status).

The I-730 should be filed with either the Texas Service Center or Nebraska Service Center depending on the petitioner's location. There is no filing fee associated with I-730.
